INFORMATION FORM FOR AGREEMENTS ON PARTICIPATION IN A TOURIST PACKAGE
The combination of travel services offered to you constitutes a tourist package within the meaning of Directive (EU) 2015/2302.
Accordingly, you shall be entitled to all applicable EU rights related to tourist packages. The company DESERT STORIES AGATA OROWIECKA-KHIDOUMA shall bear full responsibility for the proper execution of the entire tourist package.
Furthermore, in accordance with legal requirements, DESERT STORIES AGATA OROWIECKA-KHIDOUMA has safeguards in place to ensure the refund of your payments and, if transport is part of the tourist package, to ensure your return to your country in the event that DESERT STORIES AGATA OROWIECKA-KHIDOUMA becomes insolvent.
Key rights under Directive (EU) 2015/2302 include:
* Before concluding a tourist package agreement, travelers shall receive all necessary information regarding the tourist package.
* At least one entrepreneur is always responsible for the proper performance of all travel services covered by the agreement.
* Travelers shall receive an emergency telephone number or contact point through which they may reach the tour operator or travel agent.
* Travelers may transfer the tourist package to another person by providing timely notice, subject to any additional costs.
* The price of the tourist package may be increased only if specified costs (e.g., fuel costs) rise and this is explicitly provided in the agreement; under no circumstances may a price increase occur later than 20 days before the start of the tourist package. If the price increase exceeds 8% of the package price, the traveler may terminate the agreement. If the operator reserves the right to increase the price, the traveler shall have the right to a price reduction if corresponding costs decrease.
* Travelers may terminate the agreement without any termination fee and obtain a full refund of all payments if a significant element of the tourist package, other than price, changes substantially. If the entrepreneur responsible for the tourist package cancels it before its commencement, travelers are entitled to a refund and, where applicable, compensation.
* In exceptional circumstances—for example, if serious safety issues arise at the travel destination affecting the package—travelers may terminate the agreement before the package begins without any termination fee.
* Travelers may also terminate the agreement at any time before the start of the tourist package for an appropriate and justifiable fee.
* If, after the start of the tourist package, significant elements cannot be provided in accordance with the agreement, suitable alternative services shall be offered at no additional cost. If the services are not provided according to the agreement, significantly affecting the execution of the tourist package, and the tour operator cannot remedy the issue, travelers may terminate the agreement without any termination fee.
* Travelers are entitled to a price reduction or compensation for damages in case of non performance or improper performance of travel services.
* The tour operator must provide assistance to a traveler who finds themselves in a difficult situation.
* If the tour operator becomes insolvent, payments shall be refunded. If insolvency occurs after the start of the tourist package and transport is included, return to the country shall be provided.
Moreover, DESERT STORIES AGATA OROWIECKA-KHIDOUMA has taken out an insurance guarantee in connection with its activities as a tour operator or as an entrepreneur facilitating the acquisition of related travel services.
